Terms of Service

Last Updated: September 21, 2026

1. Acceptance of These Terms

These Terms of Service (“Terms”) are entered into between you and Opto Bar Optometric Inc., doing business as Opto Bar (“Opto Bar,” “Company,” “we,” “us,” or “our”).

These Terms govern your access to and use of www.optobar.com, including its content, appointment scheduling functionality, patient-facing technology, communications, and other services made available through or in connection with the website (collectively, the “Website” or “Service”).

Please read these Terms carefully.

By accessing or using the Website, creating an account, scheduling an appointment, or otherwise using our online services, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not use the Website.

2. Healthcare Services

Opto Bar provides optometric and related healthcare services through licensed healthcare professionals.

Information available on the Website is provided for general informational and administrative purposes unless you are specifically interacting with a licensed healthcare professional as part of an established patient-provider relationship.

General Website content does not constitute medical advice, diagnosis, or treatment and should not be used as a substitute for evaluation by a qualified healthcare professional.

Scheduling an appointment, submitting information through the Website, or communicating with Opto Bar does not by itself guarantee that a provider-patient relationship has been established.

Emergencies

Opto Bar's Website, messaging systems, telehealth services, and patient communication tools are not intended for medical emergencies.

If you believe you are experiencing a medical emergency, call 911 or seek appropriate emergency medical care immediately.

3. Telehealth and Remote Services

Certain Opto Bar locations or appointments may incorporate telehealth, remote optometry, digital diagnostic technology, remote provider review, or other technology-assisted healthcare services where permitted by applicable law.

Depending on the service and location, portions of an examination may be performed by trained personnel using diagnostic equipment, while a licensed optometrist may participate remotely.

The availability and appropriateness of remote services depend on factors including your location, age, symptoms, medical history, examination findings, technology availability, and applicable law.

A provider may determine that an in-person examination, additional testing, referral, or other evaluation is necessary before completing an examination, issuing a prescription, or providing treatment.

Use of remote technology does not guarantee that a prescription, diagnosis, treatment, or other requested service will be provided.

Additional telehealth notices or consent forms may apply to healthcare services.

4. Appointments and Scheduling

Appointments may be scheduled through our Website, booking systems, telephone, text messaging, or other approved scheduling channels.

You agree to provide accurate and complete information when scheduling an appointment.

Appointment availability displayed online may change and is not guaranteed until your appointment is confirmed.

We may contact you regarding:

- Appointment confirmations

- Appointment reminders

- Scheduling or rescheduling

- Provider availability

- Forms or information needed before your appointment

- Follow-up care

- Prescription or order information

- Billing or payment matters

- Other communications related to your care or services

Opto Bar may reschedule or cancel appointments due to provider availability, equipment issues, technical problems, emergencies, location closures, or other operational circumstances.

5. Cancellations, Late Arrivals, and No-Shows

Individual Opto Bar locations or services may maintain cancellation, rescheduling, late-arrival, or no-show policies.

Any applicable fees or requirements will be disclosed through the relevant booking process, patient communication, location policy, or other notice.

Late arrival may result in a shortened appointment or the need to reschedule if there is insufficient time to safely or appropriately complete the scheduled service.

6. Fees and Payments

You are responsible for charges associated with services, products, examinations, procedures, or other purchases provided to you unless otherwise required by law or covered pursuant to an applicable insurance arrangement.

Prices may vary depending on:

- Examination or service type

- Contact lens evaluation or fitting requirements

- Additional testing

- Products purchased

- Insurance coverage

- Location

- Other services requested or clinically indicated

Prices displayed online may be estimates or standard self-pay prices and may not reflect your final financial responsibility.

Payment may be collected through third-party payment processors.

We may require payment, deposits, or valid payment information before or at the time services are provided.

7. Insurance

Opto Bar may participate with certain vision or medical insurance plans at certain locations.

Participation may vary by location, provider, service, or plan.

Information provided regarding insurance eligibility or estimated benefits is not a guarantee of payment by your insurance company.

You are responsible for understanding your insurance coverage and for amounts not paid by your insurer, including applicable deductibles, copayments, coinsurance, non-covered services, or denied claims.

If an insurer subsequently denies or adjusts payment, you may be responsible for the resulting patient balance to the extent permitted by law and applicable contractual requirements.

8. Prescriptions and Clinical Decisions

All diagnoses, prescriptions, treatment recommendations, referrals, and other clinical decisions are made by appropriately licensed healthcare professionals based on their professional judgment.

Completion of testing does not guarantee that a prescription will be issued.

A provider may request additional testing, an in-person evaluation, dilation, medical evaluation, referral, or other follow-up when clinically appropriate.

Prescription validity and release are subject to applicable federal and state law.

9. Contact Lens Services

Contact lens prescriptions may require additional evaluation, fitting, diagnostic lenses, follow-up visits, or other services beyond a routine eye examination.

Contact lens examination or fitting fees may be separate from comprehensive eye examination fees.

A contact lens prescription will be finalized when the examining provider determines that the fitting and evaluation requirements have been satisfactorily completed.

10. Products and Orders

Opto Bar may facilitate purchases or orders for contact lenses, eyewear, accessories, healthcare products, or other items.

Product availability, pricing, fulfillment times, warranties, exchanges, and return policies may vary.

Certain products may be fulfilled by third-party vendors or manufacturers.

Any applicable return, refund, exchange, or warranty terms may be provided separately at the time of purchase.

11. Accounts and Patient Portal Access

Certain features may require you to create an account or access a patient portal.

You are responsible for maintaining the confidentiality of your username, password, verification codes, and other account credentials.

You agree not to allow another person to access your account without authorization.

You must notify us promptly if you believe your account has been accessed without authorization.

We may disable or restrict access to an account when reasonably necessary to protect patient information, maintain security, comply with law, or address suspected misuse.

12. Privacy and Health Information

Personal information collected through the Website is handled according to our Privacy Policy.

Information collected in connection with healthcare services may also constitute protected health information and may be subject to additional federal and state healthcare privacy laws, including the Health Insurance Portability and Accountability Act (“HIPAA”), where applicable.

Our applicable Notice of Privacy Practices provides additional information regarding how protected health information may be used and disclosed and the rights patients may have regarding that information.

You may withdraw your consent to marketing messages at any time by replying STOP.

Opting out of marketing messages does not necessarily prevent healthcare, transactional, or administrative communications that are otherwise permitted by law.

By providing your email address, you may receive transactional, appointment-related, patient-service, or administrative communications.

You may unsubscribe from marketing emails using the unsubscribe mechanism contained in those communications.

15. Changes to the Website and Services

We may modify, suspend, discontinue, or change portions of the Website or its functionality at any time.

We do not guarantee that the Website, appointment scheduling systems, patient portals, telehealth technology, or other digital services will always be available or uninterrupted.

16. Intellectual Property
